Important Notice - Law Enforcement Request Guidelines

Dear BitMart Users,

 

We are dedicated to adhering to legal regulations comprehensively, ensuring the platform and our users' safety and security with utmost commitment. In line with this commitment, we have established a set of guidelines for law enforcement officials and our users regarding requests for information, account investigations, asset preservation, and recovery. These guidelines are designed to balance our legal obligations with the privacy and rights of our users.

 

For Law Enforcement Officials

For all law enforcement actions related to BitMart users, the following protocol must be followed:

1. Submission of Requests: All law enforcement requests for user information or asset actions must be submitted to legal@bitmart.com accompanied by valid legal documents such as subpoenas, court orders, or warrants. These requests should originate from an official government email domain and must include evidence of the requester's authority.

2. Request Requirements: Requests must be detailed, specifying the nature of the investigation, the specific information or action requested, and the legal basis for the request. All documents must be provided in English or accompanied by a certified English translation.

3. Account and Asset Actions: Should law enforcement require the freezing or preservation of assets, a clear and valid legal order must be provided. The duration of any kind of restriction or suspension must be specified. We adhere strictly to lawful orders from competent judicial bodies regarding asset recovery.

4. User Privacy: We prioritize the privacy of our users. Unless legally restricted, we may notify the relevant user about the request before disclosing any personal information. We will take all necessary steps to verify the legitimacy and legal standing of requests.

5. For certain cases, we may require more information from you to ensure our compliance with applicable laws and regulations as well as internal policies and procedures of BitMart.

 

For Project Teams

When a project team identifies a need to restrict or suspend specific user accounts, possibly due to suspicious activities or as part of an ongoing investigation, the following protocol must be followed:

1. Initiating the Request: The project team must send an email detailing the accounts to be restricted or suspended to legal@bitmart.com. It's crucial that the email includes all relevant information that led to the decision of requesting an account restriction or suspension, ensuring a clear understanding of the situation.

2. Requirement for Supporting Documents: It is imperative that the project team provides supporting documents, including a police report or equivalent legal documentation. These documents are essential for validating the freeze request and determining the subsequent actions regarding the involved accounts.

For time-sensitive requests in which a police report or equivalent legal documentation is temporarily not available, BitMart has the sole discretion in deciding subsequent actions. However, such document must be provided within a 48-hour window since the first request is submitted to BitMart Legal. Otherwise BitMart may decide to withdraw all restrictions or suspensions in place. This policy is in place to balance the need for swift action with the rights and access of our users.

3. Immediate Action: Upon receiving the email with requested supporting documents and relevant information, we will review and decide whether we shall proceed to restrict or suspend related accounts. We will try to complete the review swiftly to ensure the integrity of ongoing investigations and the security of our platform.

 

For BitMart Users

1. Understanding Law Enforcement Processes: If your account is subject to investigation or action based on a law enforcement request, it is because we have received official legal documentation requiring us to do so. Our actions are strictly in compliance with legal obligations and are not arbitrary.

2. Privacy and Security: Be assured that we respect and protect your privacy and personal information. Any disclosure of your information will be in strict adherence to our Privacy Policy and applicable legal requirements.

 

General Notes

We usually require 5 – 10 work days to conduct an internal investigation to assist with a Law Enforcement Request. Please kindly note that more time may be required if the circumstances are complicated.

Nothing contained herein shall be construed as our consent to any Law Enforcement Request or our submission to any jurisdiction. We reserve all our rights including but not limited to our rights to pursue any and all available legal and equitable remedies and challenge jurisdiction.
